These Terms & Conditions (“Terms & Conditions”) apply to your use of all websites, mobile apps, and online services provided by Kofi Roasters. They do not apply to third-party sites, which you visit at your own risk. Kofi Roasters is not responsible for the content, policies, or actions of any third-party sites and does not endorse them.

By accessing or using our services, or purchasing our products, you agree to these Terms & Conditions. If you do not agree, do not use our services or purchase our products.

Personal Information We Collect

Kofi Roasters reserve the right to modify these Terms & Conditions (including suspending, restricting, or terminating access) at any time, for any reason and without notice or liability. If we update these Terms & Conditions, we will post the revised version online and update the “Last Revised” date. Your continued use of the Services after changes are posted constitutes your acceptance of the new Terms. If you do not agree to the changes, you must stop using the Services immediately.

  • Eligibility: Must be at least 13 to use our Services. Users under the age of majority require the supervision and agreement of a parent or guardian.
  • User Account and Account Security: Provide real personal info, one account per person, keep update personal info time-to-time, do not share account with others.
  • Electronic Communication: Will receive electronic communications from Kofi Roasters regarding account and transactions. If join newsletter will also received promotional emails, which can unsubscribe anytime.

Terms of Sale

    • Subscriptions: We offer different subscription plans for certain Products. For more information, please visit our Subscription FAQs on our website.
    • Continuous Subscriptions: By purchasing a subscription, you authorize our payment processor to charge you on a recurring basis until you cancel or access is suspended. Charges and billing frequency are based on your selected plan. You can manage, pause, or update your subscription at any time through your account settings.
    • Cancellation Policy: Cancel your subscription at any time via your account settings or by contacting customer support. You must cancel at least six days before your next scheduled billing or shipment date to avoid being charged; late cancellations will take effect on the following cycle. You remain responsible for all charges incurred prior to cancellation.

Payment and Billing Process

  • Provide Payment Information: By providing payment information, you represent that you are authorized to use that payment method and authorize us to charge it for the total amount of your order, including taxes and other fees. Billed amounts may vary based on promotions, location, or order changes. If your payment method cannot be verified or is invalid, your order may be suspended or cancelled until the issue is resolved. You can update your payment details at any time through your account dashboard.
  • Currency: All prices are in MYR, applicable taxes and fees are extra. We reserve the right to adjust pricing, change product availability, impose quantity limits or substitute items at any time without notice. If subscription prices change, we will notify you in advance. We do not offer price adjustments or price matching for prior purchases.
  • Product Availability: All products are subject to availability. We reserve the right to limit order quantities, reject or cancel orders and discontinue or substitute items without notice.
  • Taxes: We will collect applicable sales tax (6%) on Products.

Shipping and Delivery

  • Charges and Changes: You agree to pay the shipping fees shown at checkout. We may update our delivery rates occasionally, but we will always show you the final cost before you pay.
  • Our Couriers: Deliveries are handled by our trusted third-party courier partners (such as Grab, Food Panda or Shopee Food).
  • Delivery Time: Any shipping timelines shown on our website or phone apps are estimates. Actual delivery time may vary based on your location and peak periods.
  • Risk of Loss: We contract with third-party carriers to deliver your drinks. This means ownership and responsibility for the products pass to you once we hand the package over to the courier.
  • Purchases from Other Sites: If you purchase drinks or merchandise from any linked third-party websites or external vendors, we are not responsible for their product quality, order fulfillment, delivery, refunds, or warranties.

Intellectual Property and Website Use

  • Our Ownership: Our brand name, logos, trademarks, drink names (like our signature blends), images, text, and website content belong strictly to us or our licensors. They are protected under Malaysian and international copyright and trademark laws.
  • Prohibited Uses: You may not copy, reuse, modify, or distribute any part of our website or branding for commercial purposes, advertising, or public display without our prior written permission. Using data scraping or bots on our site is strictly prohibited.
  • Limited License: We grant you a personal, non-transferable, and revocable license to browse our website for personal, non-commercial use only. Any misuse or unauthorized use will immediately terminate this license.

Hyperlinks and Linking to Website

  • Linking: You are welcome to share or link to our website for personal, non-commercial use, provided your link is not misleading or damaging to our brand. The hosting site must not contain any illegal, offensive, or inappropriate content under Malaysian law. We reserve the right to revoke this permission at any time.
  • No Framing or Logo Use: You cannot use our official brand logo, graphics, or layout designs to create your link, nor “frame” our website content within another page, without our express written consent.
  • Third-Party Sites: We do not monitor and are not responsible for external websites that link to us. Once you click away from our website to a third-party link, our terms and privacy policies (including MCMC and PDPA compliance) no longer apply. Please review the terms of those external sites.

User-Generated Content

  • Your Content, Our License: When you share reviews, photos, or videos of our drinks on our platform, you still own your content. However, you grant us a permanent, royalty-free, worldwide right to use, repost, modify, and feature your content and username for marketing or promotional purposes without any compensation to you.
  • Your Responsibility: You promise that you own the content you post, that it doesn’t violate anyone else’s rights, and that it complies with Malaysian community standards. Publicly posted content will be visible to other users.
  • Content Removal: You may not post anything illegal, offensive, or unauthorized. While we don’t monitor every post, we reserve the right to delete or remove any user content at any time and for any reason.

Permitted and Prohibited Uses of the Website

  • Personal Use Only: This website is strictly for your personal, non-commercial use, browsing, and ordering your favorite drinks. Any unauthorized copying, modifying, or commercial exploitation of our content is prohibited.
  • Prohibited Conduct: When using our platform, you agree not to engage in any unlawful behavior, spread viruses, attempt to hack our systems, use data scraping bots, or disrupt other users’ experience.

Account Termination, Order Cancellations and Account Accuracy

  • Right to Refuse Service: We reserve the right to refuse service, terminate your account, or cancel orders at our discretion if we believe your conduct violates our terms, breaches Malaysian law, or harms our brand.
  • Order and Quantity Limits: We may limit or cancel quantities purchased per person, household, or order (including those using the same account, credit card, or address). We will attempt to notify you via your registered email or phone number if changes occur. Orders suspected of being placed by unauthorized resellers or distributors may be blocked.
  • Promotions and Vouchers: Promotional offers and promo codes cannot be combined. You cannot use promo codes if you are paying with an already-discounted gift card or voucher. Doing so may result in order cancellation.
  • Accurate Information: You agree to provide and maintain current, complete, and accurate account and payment details (such as your active email and updated card information) so we can smoothly process your transactions and contact you.

Third-Party Content and Ads

Our website may display third-party content, advertisements, or promotional links (such as partner banners or embedded social feeds). We do not own, sponsor, or endorse this content, and we are not responsible for its accuracy or safety. Accessing or interacting with these third-party links is strictly at your own risk.

Product Accuracy, Pricing and Errors

  • Errors and Typos: We strive for perfection, but occasionally errors in drink descriptions, cup sizes, images, pricing, or promo codes may occur. We do not guarantee that all website information is completely error-free. All item sizes and volumes (e.g., ml or oz) are approximate.
  • Incorrect Orders: If the product or beverage you receive does not match what you ordered or what was pictured online, your sole remedy is to return it in its original, unused, or unconsumed condition for a refund or exchange, subject to our Return Policy.
  • Our Right to Correct: In the event of a pricing or system error, we reserve the right to correct the mistake, revise your order to the correct price, or cancel the order and issue a full refund. Please contact our customer service immediately if you spot a mistake in your order.

Disclaimer and Limitation of Liability

  • Consumption and Allergies: You assume all risks regarding the safe handling, storage, and consumption of our beverages. You are solely responsible for knowing your own food allergies and verifying product ingredients before consuming them.

Release of Claims

  • Arbitration First: Except for intellectual property claims or small claims handled locally, you agree to waive your right to a court trial. Any dispute or claim arising from these terms or our services will be resolved through confidential, binding arbitration in Malaysia under the Asian International Arbitration Centre (AIAC) rules.
  • No Class Actions: All disputes must be resolved on an individual basis. You agree not to bring or participate in a class action, group arbitration, or any other representative proceeding.
  • Governing Law: These terms are governed by and construed in accordance with the laws of Malaysia. Any court proceedings to enforce arbitration awards will fall under the exclusive jurisdiction of the Malaysian courts.
  • Time Limit to File: Any claim related to these terms or our website must be filed within one (1) year after the cause of action arises, or it will be permanently barred.
